2. Starting date and termination date of the Employee
Employment Start Date: June 1, 2008. The agreement will be terminated after 1 year. There is a probation period of 2 months.
08年6月1日开始,1年后终止。2个月试用期。
问:一年后须重新签新合同?可没有提到如何续签的相关条款。
快满1年的时候,你的老板会依照你的表现,跟你谈论续约或者解约.
5. Salary
The Employee’s salary is EUR 2,700 per month. In addition the employee will receive a holiday allowances of 8% of the annual salary to be paid in the month May. Payments will be transferred monthly to employee’s bank account.
每个月2700欧,每年5月有8%年薪的节日补助。
问:这里没有提到一年多少个月工资,我和hr谈的时候是13个月,合同中没体现; 那个节日补助是否就是hr所说的第十三个月工资。2700eur在荷兰是什么水平,技术面试的结果说我是一般consultant(夹在junior和senior之间的),税后大概能拿多少? 没有提到大家所说的KM和MV,我这种情况可以申请KM吗?
难道你们公司12月不发bonus的吗?
2700*13=35100.刚好达到KM线.
6. Hours of work
The Employee’s working week will consist of 40 hours on average. The worked hours will be registered on a weekly basis. The employer is entitled for efficiency reasons to vary the weekly worked hours.
雇员平均每周工作40小时,雇主有权利调整雇员的每周工作时间。
问:这条是否意味着我可能经常被要求做没有报酬的加班。
做IT consultant,每周工作超过40小时很正常..一般没什么报酬.
8. Travel expense
All travel expenses for business purposes will be reimbursed by employer.
所有出差交通费可以报销。
问:国内一般的公司都有出差补助,是否荷兰公司一般没有。
all travel expenses不光是交通费用,还包括酒店(5星)+dinner的钱..问问你老板你们公司的标准.
9. Holiday entitlement
The Employee is entitled to 5 weeks (25 days) paid holiday per annum. Employee has to ask approval from Employer for holidays longer than 10 days.
每年有25天带薪假日。
问:这25是否包括法定假日?
不包括法定假日,25天是荷兰劳动法规定的每年最低带薪假期,每个公司还会有数量不等额外的假期,问你的HR.
11. certificate of moral conduct
The employee will provide the employer with a certificate of moral conduct. The costs of this certificate will be reimbursed by employer, except the traveling and accommodation expenses.
问:这是个什么东东,国内没听说过哦。
没听说过.

问:合同中没有提到医保,社保等东西,是否像国内一样从工资里面扣?还是包含在税里面了。
工资里口,医疗保险自己交(100欧左右/月)你申请公司的集体保险会有5%左右的优惠.
Agreement for migration to the Netherlands (移民合同?)
问:国内去荷兰工作,这条合同是否是必须的?只指移民还是仅指出国工作。
仅仅是拿到与合同等长的荷兰居留,可以工作,"暂时"不是移民.
2. Migration procedure
The total costs of the migration procedure, including advisory, lawyer, visa and travelling costs, are determined at EUR 5.000. These costs will be written off in a period of 36 months. In case employment is terminated or not extended by employee, the employee is obliged to repay the remaining migration fees as mentioned above at once. If the employee does not pass the Dutch migration procedure, no costs will be charged by the employer. In addition, if the employee does not pass the migration procedure, no contract of employment will be signed.
In the first 36 month in the Netherlands, the employee is not allowed to work for another employer in Europe without written permission of the employer. For violation, the employee is obligated to pay the employer a penalty of EUR 10.000, beside the right of the employer for total indemnification.
这一条是最让我关心的了。前面一段还好,36月内离职要按比例赔偿移民手续费,总共5000eur。第二段,36个月以内不能去欧洲的其他公司,否则赔偿10000eur(不是按比例)
问:不知道这样的合同在荷兰是否有法律效力,如果是按国内的新劳动法,肯定不会有这样高额的违约金。上面的contract是一年到期,如果一年后公司不和我签订新的劳动合同,而因为这个条款又不能去其他公司工作,那我的权利不是完全得不到保障?
也就是说,合同是一年一签,但有这个三年的条款限制我,感觉自己有点像砧板上的肉。老实说,第一年的工资扣掉税和生活费的话,不比我在国内存的多,但我看重的是在国外的项目机会和发展。但现在,第二年,第三年的工资貌似得不到法律保障,我很矛盾。招聘的时候HR告诉我每年都会有工资提升,而且第二年会有bonus,要我放心,可是这些没有体现在合同上,而且我总觉得合同不是太完善,并没有提1年后合同终止,如何续签。
关于个人发展的条款,看你们公司的"CAO",会随同合同发给你,假期,薪水涨幅,etc都能找到相关解答.
这是关系到人生的一个很重大的决定,希望GGD的华人同胞能给我一些建议或参考。这是小弟第一次出国,问的问题可能会比较幼稚,恳请大家能给点耐心解答一二,将来有机会定当面答谢。 |
