基本知识普及:Will my child have a Dutch nationality?(孩子的国籍)

这个问题很多网友在法律版块问过，我刚刚在读一些英文资料，刚好读到关于荷兰生孩子的一段文字，这儿贴上来分享给大家：

Q. I am going to have a baby in The Netherlands. Will my child have a Dutch nationality?

1.Children born in the Netherlands to two foreign parents do not acquire Dutch citizenship at birth. （如果双方都非荷兰国籍，在荷兰出生的孩子也不会是荷兰国籍）

2.If you are Dutch or married with a Dutch citizen, your child automatically acquires Dutch nationality at birth.（如果孕妇是荷兰国籍，或者孕妇是与荷兰国籍持有者结婚的，这种情况下，孩子自动获得荷兰国籍）

3.If you are not Dutch and unmarried but the father is Dutch, the father must acknowledge the child before birth or before it reaches seven years of age. After the child seventh birthday different procedures are needed. Once the child has been acknowledged, it acquires Dutch nationality. （如果孕妇不是荷兰国籍而且未结婚，但是孩子的父亲是荷兰国籍。这种情况下，父亲必须在孩子出生前承认该非婚子女或是父亲在孩子7周岁前认领，孩子获得荷兰国籍。如果孩子超过了7周岁，则需要走不同的程序）

关于第三种情况，我又继续查了点资料：

he can acknowledge the child when registering the birth or at any time afterwards and he needs the mother written consent in advance.

父亲认领非婚生子女时，需要有母亲的书面同意哦。

Dutch nationality through the father’s acknowledgment of paternity

The child of an unmarried non-Dutch mother does not acquire Dutch nationality. Until a man acknowledges the child, it has (as far as the law is concerned) no father. The child acquires Dutch nationality if:

• a Dutch man acknowledges the child before its birth or before it reaches seven years of age. This acknowledgment may take place at the town hall in the Netherlands, or in a foreign country. Once the child has been acknowledged, it acquires Dutch nationality. This rule has applied since March 2009;
• the child is acknowledged by a Dutch man after its seventh birthday, and the father provides DNA proof of his paternity within a year of that acknowledgment. If the father does not possess any DNA proof, he can apply for his child to be given Dutch nationality through the option procedure. In this case he must first raise and care for the child for three years without interruption. （如果父亲在非婚生子女7岁后认领的，则父亲在认领的一年内需要提供DNA证明；如果父亲不走DNA证明的程序，他可以通过option procedure给孩子申请荷兰国籍。这种情况下，他必须先养育照顾孩子三年，不得有中断）
  

Not every Dutch man can acknowledge a child. A married man cannot acknowledge a child without obtaining permission from a court of law.

上面提到了option procedure。来看看什么是option procedure？

Option procedure

If you want to make use of the option procedure, you must state your wish to become a Dutch national by filling in a declaration obtainable from the town hall. The municipality will check if you have a valid residence permit and if you have ever been in trouble with the police. If you meet all the conditions, the mayor will confirm that you have become a Dutch national. You must then attend a naturalisation ceremony, at which you make the citizenship pledge.

The option procedure is the fastest and easiest way of acquiring Dutch nationality. It takes about three months. It costs much less than naturalisation and there is no need to submit proof of civic integration. However, not everyone qualifies for this procedure. You may qualify for it if you have been living in the Netherlands for some time, or if you are a former Dutch national.

大致意思就是：你去市政厅领张法定声明书/宣誓纸，阐明你想拥有荷兰国籍的愿望。当地政府会审核你是否有合法居留，你是否曾经有过犯罪记录或其他不良记录。如果你符合option procedure的条件，市长会批准你加入荷兰国籍。你需要参加入籍仪式和宣誓。

上面说了，如果父亲认领非婚生孩子是在孩子7岁后，如果父亲不走提供DNA的程序，可以走option procedure为自己的非婚生孩子申请国籍。父亲可以走的就是这个程序～～

那像我们这种父母都不是荷兰籍的，想都不用想了。。

恩，是的。如果父母都不是荷兰籍，则没有可能。

是不是有规定，孩子4岁之前到荷兰，一直呆到18岁时，可以选择国籍的？我记得好像ggd上有人说过，不过我不知道是不是正确的。

我结婚前问过市政厅的人,他们说如果妈妈是中国籍爸爸荷兰籍,小孩一般跟妈妈一个国籍,如果我们要申请荷兰籍也可以,所以说还是可以选择的

如果在怀孕的过程中（出生前），父母双方有一方刚好完成了加入荷兰籍的入籍仪式呢？
