Which conditions must your relative meet?
If you want to bring a relative to the Netherlands, he has to meet the following conditions:
- He is a relative of the person he wants to visit and he can prove this with official and legalized documents
- He is not a threat to public order
- If he personally pay for his stay, he must have sufficient means of support
- His return is guaranteed
You in the Netherlands must meet the following conditions:
- If you pays for his stay; sufficient means of support;

Which documents does your relative need?
If your relative wants to come to the Netherlands for a visit, he needs a number of documents; they are listed on the application form for an authorization for temporary stay (MVV). Please note that official documents which were not issued by the Netherlands authorities must be legalized and translated by a sworn translator. Authorisation for temporary stay
You wish to bring someone to the Netherlands for longer than 3 months. The newcomer is a national of China, which has an MVV obligation. The newcomer will therefore need an authorisation for temporary stay (MVV).
The newcomer applies for an MVV in his country of origin. He uses the MVV to travel to the Netherlands. As soon as he has arrived in the Netherlands he first reports to the Aliens police. He then applies to the municipality for a temporary residence permit

The application for an authorisation for temporary stay
You can start the procedure for an authorisation for temporary stay (MVV) in two different ways:
- you (sponsor in the Netherlands) start the MVV procedure by submitting a request for advice to the IND
- the foreign national or newcomer applies for the MVV in the country of origin. This is done at a Dutch Embassy or Consulate
The objective of your request for advice is to support the MVV application the foreign national or newcomer will subsequently submit to the Embassy. The decision in response to this request for advice is a positive or negative advice only. You cannot lodge an application for review of this advice.
The application the foreign national or newcomer submits (to the Embassy) is the official application. He can lodge an application for review of a negative decision.

Starting MVV procedure
You in the Netherlands files an application for advice in respect of a MVV with the IND.
1. You submit a request to the IND for a form. This form is called Application for advice for an authorization for temporary stay.
2. You complete the above form and send it to the IND with all the necessary documents. Those documents are listed on the application form.
3. If the IND gives a positive advice, your relative can apply for a MVV with the Dutch embassy or consulate in his country of origin.
4. Your relative will not be granted a MVV if either him or you in the Netherlands fails to meet the conditions. Nor will he be granted a MVV if his documents are invalid, incomplete or incorrect. It is not possible to lodge a notice of objection against negative advice.

Applying for an MVV myself
Before your relative comes to the Netherlands, he must file an application a MVV with the Dutch embassy or consulate. That means that he starts the procedure outside the Netherlands.
1. Please go to the Dutch embassy or consulate in his country of origin.
2. He will be told which documents he has to submit. Sometimes, these documents must meet special requirements.
3. The embassy or consulate will forward his application to the IND in the Netherlands.
4. As long as he does not meet all the conditions, or any of his documents is not in order, the IND will not ask your reference in the Netherlands to submit information and documents.
5. If the IND gives a positive advice on his application a MVV, then he should contact the embassy or consulate in his country of origin to collect the MVV.
6. Your relative will not be granted a MVV if either him or yourself in the Netherlands fails to meet the conditions. Nor will he be granted a MVV if his documents are invalid, incomplete or incorrect. It is possible to lodge a notice of objection against the negative decision.
九、Issue of the MVV
Where does the relevant person collect the MVV?
The relevant person, who is a national of China, wishes to come to the Netherlands. If the IND has issued a positive advice in response to the application for an MVV, the newcomer can contact the Embassy or the Consulate in the country of origin to collect the MVV.
The MVV is a sticker. The Embassy or Consulate will check the passport and then attach the MVV to the passport.
The relevant person has 6 months to collect the MVV. Once the MVV has been attached to his passport, he has 6 months to travel to the Netherlands
Residence permit
What to do when your relative arrives in the Netherlands?
Once your relative arrives in the Netherlands, he must report to the Aliens Police within 3 working days. Then he will have to apply for a temporary residence permit at the Immigration Desk or the Department of Civil Affairs of his local municipality.
Residence permit
For his application for a temporary residence permit, the INS will check whether he meets all the conditions. He will be examined for tuberculosis .
The validity
The residence permit will be issued for a maximum period of 6 months. It is not possible to renew or extend the permit.
Important!
If he wants to apply for a residence permit in the Netherlands, the Dutch authorities need information on him. We want to deal with his data with due care. Therefore, we have the Dutch Data Protection Act in the Netherlands.

Is your relative allowed to work while holding a residence permit for the purpose of visiting relatives?
Your relative is not allowed to work while he is here for the purpose of visiting relatives. His residence permit bears the following text: 'arbeid niet toegestaan' (work is not permitted).
How can your relative obtain a ‘certificate stating that we are related’ abroad?

Can someone other than myself act as guarantor?
Yes, if you yourself cannot act as guarantor, another person may do so, provided that they have sufficient income for both their own situation and your relative's situation.
I have a temporary employment contract. Is it possible for my relative to apply for an authorization for temporary stay?
That is possible, but the IND will set a condition: You must have work for at least another 6 months from the moment that the IND receives the application for the authorization for temporary stay.
I work through a temping agency. It is possible to act as guarantor for my visiting relative?
That is possible in some cases, such as where you have had sufficient income for an uninterrupted period of three years prior to filing the application. In that case, it will suffice if the temping agency guarantees that you will have work for another 6 months. Those 6 months will start to count at the moment the IND receives the application. In every other case, the IND feels that working through a temping agency is too uncertain to act as guarantor.
