Dear Sir or Madam,
I applied for a permenant residence permit in the beginning of July. However, my stay in Holland for a consecutive 5 years will be reached at the beginning of October. I applied for it 3 months in advance according to the advice from your colleague with the telephone number of 09001234561. But my friend told me it is possilbe to be rejected because I don't fulfill the requirement of 5 years. My question is "may I ask for readmission or review, if my application were rejected". My point is if I lodge a review in October, then I will fulfill the requirement of 5 years. Do you think it is possible? Thanks.

From your e-mail I understand that you would like to know readmission or review. Below I will gladly answer your question.
To be able to apply for a residence permit for indefinite time you already need the requirements of 5 years uninterrupted legal stay in the Netherlands. You applied for this status 3 month before you meet the all the requirements. When de IND makes a decision within this 3 months you application could be denied. You have the possibility to appeal this decision within 28 days. If you do meet the requirement during the appeal it could be positive for you. If not you need to apply again for a residence permit for indefinite time.
I hope I have informed you sufficiently. |
