There are two types of J-1 sponsorship that may fit your situation. Please read the descriptions below and let me know whether you would like to be in the "Research Scholar" or the "Short-term Scholar" category of J-1.
As a Visiting Scholar in the J-1 "Research Scholar" category, you would be able to extend your stay as a Visiting Scholar up to the xxx cap of 2 years for this Visiting Scholar title, pending the approval of your xxx academic department. The J-1 immigration regulations allow those in the Research Scholar category to extend up to a maximum of 5 years, so a J-1 transfer to another institution or a xxx extension for a title other than Visiting Scholar are possibilities beyond that two year mark.
However, the Research Scholar category carries with it a "two-year bar", meaning that once the program has ended and one has therefore departed the US, an additional stay as a J-1 Research Scholar is not possible for two years, though a return as a J-1 Short-term scholar would be possible for a period of 6 months or less.
There is another J-1 category, called the J-1 "Short term Scholar" category, through which one can come for a period not to exceed 6 months. Durations beyond the 6-month period are not possible in this J-1 category. This category does not make one subject to the two-year bar, so therefore one could return again as a J-1 Research Scholar at any time after the program ends. Extensions beyond the 6-month period are not possible in this J-1 category.
If you would like to keep open the possibility of extending beyond the 6-month mark while here in the US, the J-1 Research Scholar category may be more appropriate, but if you are certain you will not be extending your stay beyond the 6-month mark, the J-1 short-term category can be used. |
