A labour migrant is a foreign national who comes to the Netherlands to work as an employee. Also included are spiritual leaders or ministers of religion. In most cases your employer will need a work permit (TWV), issued by UWV WERKbedrijf (only in Dutch).
Depending on your nationality, your employer may first need to apply for a Provisional Residence Permit (mvv) for you.
Conditions
If you wish to work as an employee in the Netherlands, you must meet the following conditions:
- Your (future) employer has applied for and has been granted an mvv for you, unless you are exempt from the mvv requirement.
- You have a valid travel document (for example a passport).
- You are not a risk to public order and national security.
- You are willing to undergo a tuberculosis test upon arrival in the Netherlands. Certain nationalities are exempt from this obligation.
- You have sufficient long-term means of support. This income must be available for at least 12 months. If your employment will be shorter than 12 months, the income must then be available for the duration as stated in your contract.
- You will earn a competitive salary, namely a salary which is in line with the market
- Your employer must have applied for/or already hold a work permit (TWV) in your name.
If you wish to stay in the Netherlands as a spiritual leader or as a minister of religion, you must also meet an additional requirement:
DocumentsYour (future) employer will submit the application for both the work permit (TWV) as well as the mvv on your behalf.
The required documents are listed in the application form. This form contains the information for both the TWV and the mvv.
CostsThe application for a provisional residence permit (mvv) and a residence permit cost money. The fees must be paid upon submitting the application form and will not be refunded if your application is rejected.
The costs for legalising documents differ for each country. For a specification of the costs, please contact the authorities in your country of origin.
The Dutch Embassy or Consulate in your country of origin may charge you for additional costs (costs for faxing documents, for instance).
Application procedureBefore you apply for the mvv and the residence permit, you are advised to contact your (potential) employer. As your employer submits the application, your employer will therefore be able to inform you as to the steps to be taken.
Simplified procedure
Your employer has the possibility to follow a fast track procedure to obtain a provisional residence permit (mvv). In that case other fees are applicable. In addition, the employer must meet the following conditions to apply for an mvv under the simplified procedure:
- The employer must sign an employer’s awareness declaration
- The company/organisation must be solvent (annual reports)
- The company is registered with the Dutch chamber of commerce. The extract of this registration may not be older than 30 days.

Right to workOn the residence document you will find your indication of work status (arbeidsmarktaantekening). This employment status tells you whether and how you are allowed to work.
As a holder of a residence permit for work as an employee you are allowed to work in the Netherlands if the employer has a work permit (TWV). This means that you are only allowed to work if your employer holds a work permit in your name.
Validity residence permitA residence permit for stay as an employee will initially be issued for the same period as the work permit (TWV). If a work permit is not required, then a residence permit will be issued for a maximum period of 1 year.
