Van der Graaf case at threat
The comments from LPF Immigration Minister Nawijn about Volkert van der Graaf, the suspected killer of Pim Fortuyn, might result in the prosecution's case being declared non-admissible, it has been claimed.
The chairperson of the Dutch Association of Criminal Law Lawyers, Mols, said Nawijn — who declared in a recent magazine interview that Van der Graaf is a murderer — did not differentiate between a suspect and a culprit. Several MPs have also made the same mistake, Mols said.
The chairperson said in combination with other violations of the presumption of innocence, a picture is being created which suggests a breach in the right to a fair trial.
Mols, who is also a criminal law professor with the Maastricht University, said the situation could lead to the prosecution's case being declared non-admissible. |
